Frequently Asked Questions?
IVA (Individual Voluntary Arrangement) in the UK with some commonly asked questions and concise answers:
1. What is an IVA (Individual Voluntary Arrangement)?
An IVA is a legally binding agreement between you and your creditors to repay a portion of your debts over a fixed period (usually 5–6 years). After this period, any remaining unsecured debt is typically written off.
2. Who is eligible for an IVA?
You may qualify for an IVA if you have over £6,000 in unsecured debt, owe money to two or more creditors, and can afford regular monthly payments. A licensed insolvency practitioner must assess your financial situation.
3. Will an IVA affect my credit score?
Yes, an IVA will appear on your credit file for six years from the date it starts. It can make obtaining credit more difficult during and shortly after the IVA period.
4. What types of debt can be included in an IVA?
Most unsecured debts like credit cards, personal loans, overdrafts, and payday loans can be included. Secured debts, student loans, court fines, and child maintenance arrears are usually excluded.
5. Do creditors have to accept the IVA?
Yes, for an IVA to be approved, at least 75% (by value) of the creditors who vote must agree to the proposal. Once approved, all creditors must comply—even those who voted against it.
6. Can I keep my home and car with an IVA?
In most cases, you can keep your home and vehicle, especially if they’re necessary for work or family. However, you may be asked to release equity in your home or downgrade a high-value car.
7. What happens if my financial situation changes during the IVA?
If your income drops or your circumstances change, your insolvency practitioner can help you review and possibly adjust your payment plan. Communication is essential to keep the IVA on track.
